1. Terms

These Terms and Conditions apply to Heyattend and the webpage users, its affiliates and providers.

By accessing this website, you are agreeing to be bound by these Website Terms and Conditions of Use and the Privacy Policy, and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site. The materials contained on this website are protected by copyright and trademark law.

Please take your time and check our terms often, as we reserve the right to amend these terms and conditions at any time, and it is possible we change them at some point.

2. Definitions

Users: a person using the Heyattend webpage and/or its software for their own purposes or in the name of any organization.

Materials: event landing pages, add-to-calendar buttons and links, RSVP forms, calendars and embeddable widgets generated with Heyattend.

Content: the event information, images and other data you upload to Heyattend to create and share your events, including the personal data of attendees who respond to your RSVP forms.

3. Service Description

Heyattend offers Free and Lifetime access to an event sharing and calendar marketing service. Users may create events and share event pages, add-to-calendar links, RSVP forms, subscription calendars and embeddable widgets for personal or commercial use.

Under this usage permission you may not:

  • modify or copy the materials beyond the customization the platform provides;
  • attempt to reverse engineer any software contained on Heyattend's website;
  • remove any copyright or other proprietary notations from the materials, except through a Heyattend plan feature that expressly removes them.

This will let Heyattend terminate upon violations of any of these restrictions. Upon termination, your usage right will also be terminated and you should stop using or destroy any downloaded materials in your possession, whether in printed or electronic format.

4. Prohibited Conduct

You agree not to commit any of the following prohibited conduct:

  • delete the copyright or other proprietary rights markings on Heyattend or in the materials;
  • make unsolicited offers, advertisements, proposals, or send junk mail or spam to other users or to attendees. This includes, but is not limited to, unsolicited advertising, promotional materials or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures;
  • in any other way use Heyattend in violation of any local, state, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, and data protection and privacy, or post, upload, or distribute any defamatory, libelous, or inaccurate submissions or other content;
  • defame, harass, abuse, threaten or defraud users of Heyattend, or upload any content to Heyattend that is unlawful or otherwise inappropriate, or collect, or attempt to collect, personal information about users, attendees or third parties without their consent;
  • hack, remove, circumvent, disable, damage or otherwise interfere with security-related features of Heyattend or uploaded content, features that prevent or restrict use or copying of any content accessible through Heyattend, or features that enforce limitations on the use of Heyattend or uploaded content, or intentionally interfere with or damage the operation of Heyattend or any user's enjoyment of it, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code;
  • reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of Heyattend or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation;
  • modify, adapt, translate or create derivative works based upon Heyattend or any generated materials except and only to the extent that such activity is expressly permitted by these Terms or applicable law notwithstanding this limitation.

5. Content uploading

By uploading content to Heyattend you hereby allow Heyattend to host, transfer, display, perform, reproduce, change, and otherwise use your uploaded content in order to provide our services to you.

  • This might happen at the time you publish your event, or later, if we deploy new functionalities.
  • We might need to transfer your content to third parties in order to provide our service; you will not be notified in such a case.
  • These licenses are transferable, royalty-free, non-exclusive, fully paid-up and apply worldwide.
  • Uploaded content will not be shared or made public by Heyattend beyond the sharing options you configure, without the express consent of the content owner.

By uploading your content, you confirm, represent, and warrant that:

  • if you wish to revoke your license to Heyattend with future effect, all you need to do is take down your uploaded content;
  • you are the sole creator and owner of all uploaded content; or
  • you have obtained the necessary licenses, rights, consents, and permissions to use and to authorize Heyattend and Heyattend's users to use and transfer your uploaded content as agreed in these Terms;
  • where your content includes personal data of attendees or other third parties, you have a valid legal basis to process it and to entrust its processing to Heyattend;
  • Heyattend may request you to confirm and document that you hold the aforementioned rights for each upload you undertake, in order to comply with EU copyright regulation.

If we receive notice that your uploaded content (or some of it) infringes third-party rights, we will take down your uploaded content if the notice is, in our opinion, sufficiently substantiated. If we take your uploaded content down, we will inform you of the takedown and grant you the opportunity to prove that you own the content. If we are satisfied with that, we may allow you to upload the content again, but we are not obliged to do so. Any subsequent upload of content that we have taken down without our permission will be considered a material breach of these Terms.

We may, without notice, introduce technologies that are aimed at detecting copyright infringements in connection with uploads and other measures to ensure that content is only uploaded in accordance with the requirements. In such a case, the software will notify our team, who will eventually decide whether to take it down or not.

If you think that your copyright has been infringed by, or you have a complaint in respect of, any content published through Heyattend, please report it to [email protected].

You further confirm, represent, and warrant that:

  • your uploaded content does not and will not: (i) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right, or (ii) slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person; and
  • your uploaded content does not contain any viruses, adware, spyware, worms, or other malicious code or any content or file that provides a method to access potentially infringing content outside of Heyattend.

Violators of third-party rights may be subject to criminal and civil liability and to Heyattend undertaking a takedown of uploaded content without notice. Heyattend reserves the right, and has absolute discretion, to take down or disable any uploaded content at any time and for any reason without notice. If possible, Heyattend will give notice to you before we take down your uploaded content, but we are not obliged to do so.

6. Plans and payment

The Free plan includes the core Heyattend event workflow with unlimited events and unlimited RSVP response records. It allows 60 successful attendee notification email deliveries per UTC calendar month and 30 successful organizer notification or digest sends per UTC calendar month. The first day of each UTC month begins a new monthly allowance. Browser push notifications, test sends, RSVP confirmations and attendee reminder emails do not consume the attendee-notification allowance.

When a Free email limit is reached, additional quota-controlled emails are skipped rather than queued for a later month. Organizer capacity and waitlist settings remain independent organizer-controlled features.

Lifetime costs $49 USD as a one-time payment for one workspace and all members of that workspace. It removes the Powered by Heyattend badge and the two email plan limits listed above. It is not a subscription and does not renew. “Lifetime” means these plan benefits remain attached to the workspace for as long as Heyattend operates the service; it does not guarantee that the service or any particular feature will operate indefinitely.

Payments are processed by Stripe. Workspace owners and admins can download the Stripe invoice from Account settings after payment. Refunds are provided where required by applicable law; contact [email protected] with a request. Plan access remains subject to these Terms, anti-spam controls, technical safeguards and reasonable measures needed to protect Heyattend and its users.

We may add, change or discontinue features as the service develops. Material changes to these terms will be published on this page. Content may be taken down or otherwise restricted when required by these terms or applicable law.

7. Account termination

You may stop using Heyattend at any time. We may suspend or terminate access when these terms are violated, when necessary to protect the service or its users, or when we discontinue the service.

8. Service availability

We aim to keep Heyattend available and reliable, but we do not guarantee uninterrupted operation. Features may occasionally be unavailable because of maintenance, security work, third-party outages or technical errors.

9. Bugs and issues

Heyattend may contain functional, conceptual or documentation errors. We work to correct reported issues and provide updates, but cannot guarantee that every issue will be fixed immediately.

10. Disclaimer

All the materials on Heyattend's website are provided "as is". Heyattend makes no warranties, be they expressed or implied, and therefore negates all other warranties. Furthermore, Heyattend does not make any representations concerning the accuracy or reliability of the use of the materials on its website or otherwise relating to such materials or any sites linked to this website.

11. Limitations

Heyattend or its suppliers will not be held accountable for any damages that arise from the use of, or inability to use, the materials on Heyattend's website, even if Heyattend or an authorized representative of this website has been notified, orally or in writing, of the possibility of such damage. Some jurisdictions do not allow limitations on implied warranties or limitations of liability for incidental damages; these limitations may not apply to you.

12. Revisions and Errata

The materials appearing on Heyattend's website may include technical, typographical, or photographic errors. Heyattend does not promise that any of the materials on this website are accurate, complete, or current. Heyattend may change the materials contained on its website at any time without notice. Heyattend does not make any commitment to update the materials.

13. Links

Heyattend has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The presence of any link does not imply endorsement by Heyattend of the site. The use of any linked website is at the user's own risk.

14. Your Privacy

Heyattend processes personal data in two contexts:

  • Personal data of users whose processing is necessary to provide the service.
  • Personal data included in the content uploaded by the user (for example, attendee registrations). In this case, Heyattend acts as a "processor".

Details about the processing of personal data by Heyattend are described in the Privacy Policy.

15. Governing Law

Any claim related to Heyattend's website shall be governed by the laws of Spain without regard to its conflict of law provisions.
